Problem with storage of neighbor's trash can

Hi all,

First, I am not a resident of our lovely part of town. But I have a problem that I hope any of you can answer as I cannot get a resolution anywhere else after e-mails to city officials, et al.

I am having trouble with a neighbor who keeps their trash can in plain view rather than store it out of sight like everybody else in the neighborhood. They also push it up against a fence I installed between the driveways. I have asked the residents repeatedly to store it properly since the smell it emits after a week of cut grass being stored in it--along with the regular trash--is downright unbearable to myself and family.

After three years, he has not complied. Additionally, the trash can obscures the view when pulling out of our driveway which also makes it a safety hazard.

If I understand correctly, there is some sort of City Code that prohibits the storage of trash cans in plain view on days other than pickup days. Am I correct?

I have tried contacting everybody I can think of in the city including Kym Cloug. I would like to resolve this issue once and for all.

Any help anyone can provide would be appreciated.

BHCA charter

Hi moreno91-

I can empathize with your situation, however Belmont Heights Community Association does not get involved with neighbor to neighbor disputes. The essence of the BHCA charter is to focus on neighborhood and quality of life issues that affect us all and to help coordinate the creation of constructs to maintain and improve our quality of life in Belmont Heights (and sometimes Long Beach in general).

Our website was setup to help neighbors find eachother and more effectively communicate.

If you feel someone in your neighborhood is acting inappropriately and breaking the law, that is for you to take up with the Police Department.

In addition, you are more than welcome to post to our website asking other neighbors for advice, however, BHCA will not take a direct position on your particular problem.
If however your issue turns out to be symptomatic of a larger issue, in which the city has no direct means to address, then the BHCA would begin to to take interest in your problem -- however, you also said you're not a resident of Belmont Heights.

I wish you luck resolving your problem, and would be interested in hearing how it turns out. I'd also be interested in hearing other people's thoughts.

Mike, you wrote a wonderful response to moreno91's neighbor problem.  The mission statement is very clear on BHCA not getting involved in neighbor to neighbor disputes which you mentioned in your reply.  I, also, empathize with moreno91's trash can problem, but think he needs to continue working with the city, and his other neighbors.

Trash Can problem

My understanding is that the City's municipal code stipulates that trash cans, unless there is an alley behind your property, be kept from the view of the public right-of-way on days other than collection days.  It is also not legal to place your trash can at the curb before 6 am on the day of collection (although I and most of my neighbors do just that) and/or leave it there more than 12 hours after collection.

 If your are having a chronic problem with a neighbor not storing cans properly, I would suggest that you call the City's code enforcement department at 570-CODE (2633).  Good luck!
